You don't need an air tight case to fire someone ... but you need to know these factors.

Before writing such a notification, you must clearly explain the behaviors and performance you expect from the jobholder. And, if the dismissed worker wants to negotiate her separation package, you should get the proper supervisor involved to follow up. I recognize that I've received a copy of this separation letter. If the behavior remains poor, then it's time for formal escalating discipline that will likely lead to the bad employee's termination.

As well, if the worker's conduct goes against all firm policies, you may decide to table the discussions of terminating personnel and employer conduct. Ideally, having a third party conduct the exit interview or having the worker fill out an exit interview form before they leave would yield more honest and objective comments. Lastly, when the incident occurs again, you dismiss the employee. Remember when discussing the circumstance with a jobholder to continue to reiterate why it is important that they do not behave in this way. It is important that you gather all prior papers on job productivity and remedial measures. In this case, you may have given the worker a oral warning to improve within 30 days and she didn't. Even if you're the firm's CEO, you must get an independent review of any lay off.
