THE WARRIOR - New York Post (How To Fire An Employee)

You don't need an air tight case to fire someone ... but you need to know these factors.

Cover Notification To Include With Letter Of Recommendation. As you might expect, keeping healthcare coverage is a priority for most workforce. If you currently don't have a process, it is time to set one up. Allow them to come back into the office to get their belongings, say good-bye to their coworkers and give notice to the workplace of their sacking. As long as the outside behavior doesn't affect their work performance or the productivity of your company, you can't fire them without fear of a illegal dismissal suit. Tactful language and providing a way of leaving the firm with dignity in front of other personnel are conditions for making the termination process less painful for everyone involved. You must also include all wages earned, as well as all vacation time, sick time, and personal time earned up through the date of lay off. If the individual refuses to sign then just note this on the notice and make sure you have a witness in the termination meeting. Terminating a jobholder is never an easy method either for you or the worker, but sometimes you will have no choice. Before starting down the path of employee separation, consider the following: If a company does not have these rules in place, then it can become difficult to enforce a firing. *Do I need to give the jobholder a notification of dismissal?

It should explain your previous attempts to correct the employee with dates, a statement communicating the employee is fired effective on a date, and any final pay and severance packages. I haven't done a scientific study on the quantitative chance of a lawsuit for each of these. If you're a top level supervisor, have one of your senior managers or have an employment legal defender review it. It occurs a few days after the jobholder's lay off.
